Ownership-form decision

What is the difference between a co-op and a condo in South Florida?

Short answer

The forms differ in what the buyer receives and which Florida statute governs. In a cooperative, legal title is held by the association and the buyer receives an ownership interest together with a lease or other muniment of title. A condominium conveys the unit with an undivided share of the common elements.

Compare what each ownership form conveys

Section 719.103 defines a cooperative as a form in which legal title is vested in a corporation or other entity and beneficial use is evidenced by an ownership interest in the association together with a lease or other muniment of title or possession. The statute also states that an interest in a unit is an interest in real property.

Apply inspections and reserve studies to both forms

Section 553.899 addresses milestone inspections for condominium and cooperative buildings three habitable stories or more in height, subject to its terms and exclusions. Section 719.106 requires a structural integrity reserve study at least every 10 years for each cooperative building that is three habitable stories or higher, as determined by the Florida Building Code. Use the reserve-study comparison to identify the record supplied.

03

Read approval, transfer, and use restrictions

Review the actual governing documents for transfer procedures, fees, leasing limits, occupancy terms, pets, and parking. The written process and current records establish what applies to the specific property; fair-housing, legal, and title conclusions belong with qualified professionals.

04

Keep financing and insurance review property-specific

The lender determines the project and property review required for a proposed loan. The insurance and eligibility guide and FHA project-search guide organize separate diligence questions without predicting an approval result.

05

Fit the form into the complete buyer file

Return to the condo buyer hub and the document checklist for the broader review. The condo versus fee-simple villa comparison addresses a different ownership boundary. If the seller is an estate, the Broward probate sale guide separates authority to convey from the property form.
